Terms of Service

The terms that govern access to Notiva Mail and use of its transactional email delivery service.

Agreement to these terms

These Terms of Service form an agreement between you and Centipid Technologies for use of Notiva Mail. By creating an account, accepting these terms, or using the service, you agree to them and to the Privacy Policy and Cookie Policy.

If you use Notiva Mail for an organization, you represent that you can bind that organization. In that case, “you” means the organization and its authorized users.

Accounts and authority

You must provide accurate account information, maintain a valid email address, and be legally able to enter this agreement. You are responsible for activity under your account and for assigning workspace access only to authorized people.

Keep passwords, API keys, webhook secrets, and recovery methods confidential. Tell us promptly through the contact page if you suspect unauthorized access. We may require email verification or other reasonable checks before enabling or restoring service capabilities.

Using the service

Notiva Mail provides an API and related tools for transactional email delivery. You are responsible for your applications, message content, recipient lists, sending domains, DNS records, webhook endpoints, and compliance with laws and provider policies that apply to your use.

You grant us permission to process message content and related data only as needed to provide, secure, support, and improve the operational reliability of the service. You retain your rights in content you submit.

Acceptable use

You may not use Notiva Mail for unsolicited bulk or marketing email, phishing, fraud, malware, harassment, unlawful content, deceptive sender identities, purchased recipient lists, or activity that violates another person's rights.

You may not bypass quotas or suppressions, probe or disrupt the service, attempt unauthorized access, share credentials outside authorized workspace use, interfere with other tenants, or use the service in a way that harms delivery reputation. You must honor unsubscribe, bounce, complaint, and consent requirements applicable to your messages.

Plans and fees

Your plan determines available message volume, daily limits, domain allowances, and features. The Free plan has no recurring fee. Paid plans shown before billing is enabled are informational and require a separate sales or service agreement before activation.

Where a paid plan is activated, pricing, billing intervals, taxes, overages, and cancellation terms will be presented before purchase or recorded in the applicable order. We do not charge for a paid plan without an implemented checkout or an explicit agreement.

Availability and delivery

We work to keep Notiva Mail available and to process accepted messages reliably, but email delivery depends on networks, DNS, recipient systems, infrastructure providers, and sender reputation outside our control. Acceptance by the API does not guarantee inbox placement or delivery by a particular time.

We may perform maintenance, change providers, impose reasonable rate limits, or modify features to protect reliability and security. Public operational status is available from the service's Status page when that surface is available.

Data and security responsibilities

You must use reasonable safeguards in your application, restrict credentials to their intended abilities, verify webhook signatures, and avoid placing secrets in client-side code. You are responsible for obtaining permission to process recipient data and for the accuracy and legality of message content.

Our handling of service data is described in the Privacy Policy. You should retain your own business records and source message data where required; Notiva Mail is not a permanent archive.

Suspension and termination

You may stop using the service at any time and may ask us to close your account. We may limit, suspend, or terminate access when reasonably necessary for security, nonpayment, legal compliance, provider requirements, material breach, harmful sending, or risk to delivery reputation or other users.

Where practical, we will provide notice and an opportunity to correct the issue. Immediate action may be required for active abuse, credential compromise, unlawful conduct, or operational danger. Provisions that by nature should survive termination, including payment obligations, disclaimers, liability limits, and dispute terms, remain effective.

Warranties and liability

Notiva Mail is provided on an “as is” and “as available” basis to the extent permitted by law. We do not promise uninterrupted operation, error-free delivery, inbox placement, or compatibility with every recipient or provider.

To the extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, goodwill, or data. Our aggregate liability arising from the service will not exceed the amount you paid for Notiva Mail during the six months before the event giving rise to the claim. These limits do not apply where the law does not allow them.

Governing law and disputes

These terms and any dispute arising from Notiva Mail are governed by the laws of Kenya, without regard to conflict-of-law rules.

Before beginning formal proceedings, each party will give written notice describing the dispute and attempt a good-faith informal resolution for 30 days. If the dispute is not resolved during that period, each party submits to the exclusive jurisdiction of the competent courts of Kenya.

Changes and contact

We may update these terms to reflect service, security, provider, or legal changes. Revised terms will appear here with a new effective date. If a material change requires acceptance, we may ask you to accept it before continuing to use the service.
